1. THE SERVICES

CallMyYoga provides live online yoga classes conducted via video conferencing with certified yoga instructors from India.

What we provide: - Live group yoga classes (Monday through Friday, scheduled times) - Real-time instruction and posture correction - Personalized feedback during live sessions - Future services: Individual 1-on-1 yoga sessions (when available)

What we do NOT provide: - We do not provide recorded or on-demand yoga videos - We do not provide medical diagnosis, treatment, or physiotherapy services - We do not prescribe medications, supplements, or medical treatments - We do not offer AI-based assessments or medical consultations

2. USER ELIGIBILITY

Age Requirement: You must be at least 18 years old to register. If you are under 18, your parent or legal guardian must register on your behalf and supervise your use.

Health Responsibility: You represent that you are physically capable of participating in yoga, have consulted a healthcare provider if needed, and understand that yoga involves physical activity and carries inherent risks.

Geographic Availability: Our Services are available internationally. You are responsible for ensuring compliance with all laws in your jurisdiction.

3. ACCOUNT REGISTRATION

To access the Services, you must create an account by providing your full name, valid email address, payment information (after free trial), and any additional information we may reasonably request.

You agree to: - Provide accurate, current, and complete information - Maintain and promptly update your account information - Not impersonate any other person or entity - Not create accounts on behalf of others without authorization - Keep your login credentials confidential and secure - Notify us immediately of any unauthorized use of your account

4. FREE TRIAL & SUBSCRIPTIONS

4.1 Free Trial

We offer a 3-day free trial for new users: - No credit card required to start the trial - Access to live group classes during the trial period - Trial begins on your first class attendance - After 3 days, you must select a subscription plan to continue

4.2 Subscription Plans

After your free trial, you may subscribe to: - 3-month subscription (billed every 90 days) - 6-month subscription (billed every 180 days) - 12-month subscription (billed every 365 days)

Pricing: - India: Prices displayed in Indian Rupees (₹), inclusive of 18% GST - International: Prices displayed in US Dollars ($), no GST applicable - Current pricing is available on our website

4.3 Auto-Renewal

All subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price for your selected plan.

4.4 Payment

• Payment is processed through our payment gateway (Razorpay or equivalent)
• By subscribing, you authorize us to charge your designated payment method
• You must maintain valid payment information while subscribed
• Failed payments may result in suspension of your account

5. CANCELLATION & REFUNDS

5.1 Cancellation

You may cancel your subscription at any time: - Cancellation takes effect at the end of your current billing period - You retain access to Services until the end of the paid period - No prorated refunds for partial months

5.2 Refund Policy

Within 7 days of payment: - Full refund available if you have attended fewer than 3 classes - Refund requests must be submitted via email to support@callmyyoga.com - Refunds processed within 7-10 business days

After 7 days: - No refunds for subscriptions, except as required by applicable law - Cancellation will prevent future billing but does not entitle you to a refund for the current period

No refunds for: - Classes you did not attend - Indian national holidays when classes are not scheduled - Your personal schedule conflicts or inability to attend

6. ACCEPTABLE USE

You agree to use the Services only for lawful purposes and in accordance with these Terms.

You may NOT: - Record, screenshot, or distribute any portion of our classes without written permission - Share your account credentials with others - Use the Services for any commercial purpose without authorization - Disrupt, interfere with, or attempt to gain unauthorized access to our systems - Upload viruses, malware, or any harmful code - Impersonate any person or entity - Harass, threaten, or abuse instructors or other users - Use automated systems (bots, scrapers, etc.) to access the Services - Reverse engineer or attempt to extract source code from our platform - Violate any applicable laws or regulations

Violation of these rules may result in immediate termination of your account without refund.

7. CLASS CONDUCT

During live classes, you agree to: - Keep your camera ON as required for posture correction - Mute your microphone unless instructed otherwise - Wear appropriate yoga attire - Practice in a safe, suitable space - Follow instructor guidance - Respect other participants

Instructors reserve the right to remove disruptive participants from a class.

8. HEALTH & SAFETY DISCLAIMER

Important Disclaimer: CallMyYoga does not provide medical advice, diagnosis, or treatment. Our Services are for general wellness and fitness purposes only. If you have medical concerns, consult a qualified healthcare provider.

8.2 Assumption of Risk

Yoga practice involves physical activity that carries inherent risks. By using our Services, you acknowledge that you are voluntarily participating, understand the risks, are solely responsible for determining your physical ability, and waive any claims against CallMyYoga for injuries.

8.3 Medical Clearance

You must consult a healthcare provider before using our Services if you have: pregnancy, recent surgery or injury, cardiovascular conditions, high or low blood pressure, joint problems or chronic pain, or any condition that may be affected by physical activity.

9. INTELLECTUAL PROPERTY

9.1 Our Content

All content on our platform, including: - Website design and layout - Class sequences and instruction methods - Videos, images, and text - Trademarks, logos, and brand name - Software and technology ...is the exclusive property of CallMyYoga and is protected by copyright, trademark, and other intellectual property laws.

9.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial purposes only. This license does not include any right to: - Reproduce, distribute, or publicly display our content - Create derivative works - Use our content for commercial purposes - Remove copyright or proprietary notices

9.3 Recording Prohibition

You may NOT record, screenshot, or otherwise capture any portion of our live classes. Unauthorized recording is a violation of these Terms and may result in immediate termination and legal action.

10. USER-GENERATED CONTENT

If we enable features for you to post content (such as comments, reviews, or photos):

You grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating and promoting our Services.

You represent that: - You own or have rights to any content you post - Your content does not violate any third-party rights - Your content is accurate and not misleading

We reserve the right to remove any user content that violates these Terms or is otherwise objectionable, without notice.

11. PRIVACY

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our Privacy Policy.

We may modify these Terms at any time by posting updated Terms on our website. Continued use of the Services after changes constitutes your acceptance of the modified Terms. Material changes will be communicated via email when possible.

15. DISCLAIMERS

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Fitness for a Particular Purpose: We do not warrant that the Services will meet your specific needs or goals
• Accuracy: We do not guarantee the accuracy of instructional content
• Availability: We do not guarantee uninterrupted or error-free service
• Results: We do not guarantee any specific health, fitness, or wellness results

Technical Issues: Internet connectivity, video quality, and technical performance depend on factors outside our control. We are not responsible for: - Network interruptions or poor internet connection - Compatibility issues with your device - Technical problems with third party platforms (video conferencing, payment gateways)

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CallMyYoga, its directors, employees, instructors, and affiliates shall NOT be liable for any: - Indirect, incidental, consequential, or punitive damages - Personal injury, illness, or death arising from your use of the Services - Loss of data, profits, or business opportunities - Emotional distress or other intangible losses

MAXIMUM LIABILITY: Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability. In such cases, our liability is limited to the maximum extent permitted by law.

17. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless CallMyYoga and its directors, officers, employees, instructors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: - Your use of the Services - Your violation of these Terms - Your violation of any third-party rights - Any injury you sustain while using the Services - Any content you post or submit

18. DISPUTE RESOLUTION

These Terms are governed by the laws of India, without regard to conflict of law principles.

18.3 Jurisdiction

You agree that any legal action arising from these Terms or the Services shall be brought exclusively in the courts of Noida, Uttar Pradesh, India. You consent to the personal jurisdiction of these courts and waive any objection based on inconvenient forum.

19. GENERAL PROVISIONS

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CallMyYoga regarding the Services.

19.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

19.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

19.4 Assignment

You may not assign or transfer these Terms or your account. We may assign these Terms to any successor or affiliate without your consent.

These Terms do not create any third-party beneficiary rights.

20. TERMINATION

20.1 By You

You may terminate your account at any time by canceling your subscription through your account settings or by contacting support@callmyyoga.com.

20.2 By Us

We may suspend or terminate your account immediately, without notice, if: - You violate these Terms - Your payment fails - You engage in fraudulent activity - We discontinue the Services - Required by law

Upon termination: - Your access to the Services ends immediately - You remain liable for any outstanding payments - Sections that by their nature should survive (liability limitations, indemnification, governing law) remain in effect

22. CONSENT TO COMMUNICATIONS

You may opt out of marketing communications at any time, but you cannot opt out of essential service communications.

India DND Register: You authorize CallMyYoga to send you messages even if your number is registered with the National Do Not Call Registry. This consent is valid for the duration of your subscription and will auto-renew with your subscription unless you opt out by emailing support@callmyyoga.com.

ACKNOWLEDGMENT

BY USING CALLMYYOGA’S SERVICES, YOU ACKNOWLEDGE THAT: - You have read and understood these Terms - You agree to be bound by these Terms - You understand the risks of yoga practice and assume those risks - You will consult a healthcare provider if you have any health concerns - You will practice yoga safely and within your limits
